  • Management of the relationship with collaborators. The main purpose of this data processing activity is to manage your status as an AIR Institute collaborator in order to enable you to benefit from the associated advantages. Reports Channel

The sending of personal information through the Reports Channel or any of the means envisaged in the Code of Conduct may require, in certain cases, depending on the subject of the report, the processing of personal data of the person who has made the report, as well as of the person that is being reported.

In this regard, the personal data collected through the Internal Information System shall be processed for the purposes of managing, processing, and investigating the communications sent, as well as for adopting disciplinary measures or processing the administrative or judicial proceedings that, where appropriate, may be required.

1. The legitimate basis for processing the personal data collected through the Internal Information System is:

  • Compliance with AIR INSTITTUTE's legal obligations to have an Internal Reporting System.
  • Legitimate interest when the communication reports a breach of AIR Institute's internal procedures, policies and regulations regarding conduct that does not fall within the scope of the Informant Protection Act. In such cases, the legitimate interest of the data controller is to minimise the negative impact resulting from such conduct and to reinforce the culture of compliance with AIR Institute's internal policies and procedures.

In addition, the Informant must provide consent in the event that a recording of their voice is made in accordance with the provisions of Article 7 of the Informant Protection Act.

Persons making a report through the Reports Channel or any of the means provided for in the Code of Conduct must ensure that the personal data provided is true, accurate, complete, and up to date.

The personal data you provide may be communicated to those third parties to whom the data controller is obliged to transmit information, such as public administrations, Courts and Tribunals, in order to comply with the requirements of such authorities and the applicable regulations, where applicable. Are there any international data transfers?

The use of WhatsApp as a communication channel may involve access to personal data by WhatsApp Ireland Limited, which may involve the processing of personal data from outside the European Economic Area. Notwithstanding the foregoing, in the event that it is necessary to carry out international transfers of your personal data to countries whose level of data protection is not considered adequate by the European Commission, appropriate safeguards will be in place, in accordance with applicable law, to protect your personal data at all times.

Retention Time:

In compliance with the principles of limitation in the retention period, the data collected will be processed only and exclusively for the time necessary and for the purposes for which they were collected.

  • Availability: through resource allocation policies and backup policies that reach all systems including projects and services provided to users. Systematic data recovery tests are conducted in the event of serious incidents that could limit data availability.
  • Implementation of resilience mechanisms, which allow for the monitoring and rapid detection of incidents and ensure the articulation of planned recovery mechanisms.
  • Implementation of incident response protocols, both physical and logical, to ensure rapid and effective resolution of incidents.

Exercise of rights:

AIR Institute will use social networks as a means of communication and promotion of its services. In no case we will use the data for purposes not permitted. This company is not responsible for the content, comments, opinions, or information, own or third parties, that users post on our accounts created on Facebook, Twitter, LinkedIn, YouTube, etc. You may use our content for lawful purposes, as long as you mention its origin or author. The purpose of the data collected will be the database of users and contacts of the company's social network accounts. Processing of images of people:

AIR Institute informs that, in the case of processing related to the management and attendance to events, it is possible to take pictures and/or film videos of attendees, take wide shots and capture ambient sound. The purpose is to publicize and promote the image and brand of AIR Institute on its own and third party media, both internally and externally, in order to provide greater visibility to the entity and to shape a public image of AIR Institute and the people who relate to it in accordance with the ideals and values that govern its activity, through the dissemination of the activities and events it organizes.

The processing of the images of the interested parties, employees or collaborators respects the person, in accordance with the Organic Law 1/1982 of May 5, 1982, on the protection of the right to honour, to personal and family privacy and to one's own image, by eliminating any images of videos that could violate fundamental rights.

Confidentiality and security of your data:

AIR Institute has adopted the necessary measures to avoid the alteration, loss, unauthorised processing and access to personal data, taking into account at all times the state of technology, however, the User must be aware that security measures on the Internet are not impregnable.

The data obtained through the Website and/or any other means, will be processed by the CONTROLLER with absolute confidentiality, undertaking to keep them secret.

That in accordance with the provisions of the regulations in force on Personal Data Protection, the CONTROLLER complies with all the provisions of the GDPR and LOPDGDD regulations for the processing of personal data under their responsibility, and manifestly with the principles described in Article 5 of the GDPR and Title II of the LOPDGDD, by which they are processed in a lawful, fair and transparent manner in relation to the data subject and adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.
